CuraCare is a directory and informational platform. We are not a healthcare provider, licensed care facility, medical practice, or clinical service. We do not diagnose, treat, or manage any medical condition. Nothing on CuraCare should be interpreted as the practice of medicine or healthcare.

No Medical Advice

The information provided on CuraCare, including content generated by our AI assistant Amica, is for general informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition or care decision.

Information Accuracy

CuraCare aggregates data from public sources including CMS.gov (Centers for Medicare & Medicaid Services) and Google Places. While we make every effort to keep information current and accurate, we cannot guarantee that all data displayed is complete, up-to-date, or error-free. Facility details including pricing, availability, services, and ratings may change without notice.

No Endorsement

The listing of any facility on CuraCare does not constitute an endorsement, recommendation, or referral by CuraCare. We do not evaluate, certify, or inspect facilities. Inclusion in our directory is based on publicly available data, not on any business relationship or payment.

No Guarantee of Quality

CuraCare cannot guarantee the quality of care, safety, or suitability of any facility listed on our platform. Past performance, ratings, and reviews are not guarantees of future quality. We strongly encourage families to conduct their own research, visit facilities in person, and consult with healthcare professionals before making any care decision.

User Responsibility

Families and individuals are solely responsible for their own due diligence when selecting a senior living facility. This includes verifying licensing, inspecting facilities, reviewing contracts, understanding costs, and assessing whether a facility meets their specific care needs. CuraCare provides tools and information to assist in this process but cannot replace personal evaluation.

CuraCare does not control, endorse, or assume responsibility for the content, privacy practices, or availability of any third-party sites.


2. Data Sources & Accuracy

CMS.gov Data

Facility information including provider details, inspection results, staffing data, quality ratings, and bed counts is sourced from publicly available datasets published by the Centers for Medicare & Medicaid Services (CMS.gov). This data is updated periodically by CMS and may not reflect the most recent changes at a facility. CuraCare refreshes this data regularly but cannot guarantee real-time accuracy.

Google Places Data

Photos and external ratings displayed on CuraCare may be sourced from the Google Places API. These are provided by Google and its users, not by CuraCare. Google ratings and photos are subject to Google's terms and may differ from CuraCare's own rating methodology. CuraCare does not verify the accuracy of Google-sourced content.

AI-Generated Content

Certain facility summaries, descriptions, and responses from our AI assistant Amica are generated using artificial intelligence (Claude by Anthropic). While we design these features to be helpful and accurate, AI-generated content may contain errors, omissions, or outdated information. AI-generated content is clearly labeled where applicable and should not be relied upon as the sole basis for any care decision.

Pricing Disclaimer

Prices displayed on CuraCare are estimates based on publicly available information and may not reflect current pricing at any facility. Actual costs vary based on care level, room type, location, and individual needs. Always contact facilities directly for accurate, up-to-date pricing.

Availability Disclaimer

Bed availability and capacity information is based on publicly reported data and may not reflect real-time availability. CuraCare cannot guarantee that any facility has current openings. Contact facilities directly to confirm availability.

Rating Methodology

CuraCare displays ratings from multiple sources including CMS quality ratings and user-submitted reviews. Our platform does not manipulate or weight ratings based on business relationships. 3. Financial Disclaimers

Not Financial Advice

Nothing on CuraCare constitutes financial, tax, or insurance advice. Information about costs, payment options, and financial assistance programs is provided for general informational purposes only. Consult with a qualified financial advisor, elder law attorney, or insurance specialist for advice specific to your situation.

Medicare & Medicaid Information

Information about Medicare and Medicaid coverage, eligibility, and benefits displayed on CuraCare is general in nature and sourced from public CMS data. It is not specific to your individual situation, state of residence, or coverage plan. Eligibility and benefits vary by state, plan, and individual circumstances. Contact Medicare (1-800-MEDICARE), your state Medicaid office, or a benefits counselor for personalized information.

Cost Estimates

All cost estimates, price ranges, and financial comparisons on CuraCare are approximate and provided for planning purposes only. Actual costs depend on many factors including care level, room type, geographic location, additional services, and facility policies. CuraCare does not receive referral fees from facilities listed in our free directory, and listings are not influenced by any financial relationship.


4. Liability Limitations

Limitation of Liability

To the fullest extent permitted by applicable law, CuraCare and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of or inability to use the CuraCare platform, regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if CuraCare has been advised of the possibility of such damages.

Indemnification

By using CuraCare, you agree to indemnify, defend, and hold harmless CuraCare and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the platform, your violation of these disclaimers or any applicable law, or your violation of any rights of a third party. Full indemnification terms are set forth in our Terms of Service.

No Warranty

CuraCare is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. CuraCare does not warrant that the platform will be uninterrupted, timely, secure, or error-free, or that the information provided is accurate, reliable, or complete.

Force Majeure

CuraCare shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government actions, power failures, internet disruptions, or failures of third-party services including data providers and cloud infrastructure.


5. US Federal Compliance

ADA Compliance

CuraCare is committed to ensuring digital accessibility for people with disabilities. We continually improve the user experience for everyone and apply the relevant accessibility standards. CuraCare does not discriminate on the basis of race, color, religion, sex, national origin, familial status, disability, or any other protected class.

Fair Housing Act

CuraCare is committed to compliance with the Fair Housing Act (42 U.S.C. 3601 et seq.) and does not knowingly list facilities that engage in discriminatory housing practices. If you believe a listed facility is engaging in discrimination, please contact us or file a complaint with HUD at hud.gov.

HIPAA Disclaimer

CuraCare is not a "covered entity" or "business associate" as defined under the Health Insurance Portability and Accountability Act (HIPAA). We do not access, store, or transmit protected health information (PHI). However, we take the privacy and security of all user data seriously and implement industry-standard protections as described in our Privacy Policy.

CAN-SPAM Compliance

CuraCare complies with the CAN-SPAM Act (15 U.S.C. 7701 et seq.). We do not send unsolicited commercial email. Any marketing communications you receive from CuraCare will include a clear unsubscribe mechanism, our physical mailing address, and accurate subject lines. You may opt out of marketing emails at any time.

COPPA Compliance

CuraCare complies with the Children's Online Privacy Protection Act (COPPA). Our platform is not directed at children under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us so we can promptly delete it.

FTC Endorsement Guidelines

CuraCare complies with the Federal Trade Commission's Endorsement Guides (16 CFR Part 255). User reviews published on CuraCare represent the genuine opinions of the individuals who submitted them. Reviews are moderated for spam and abusive content but are not edited for sentiment. CuraCare does not pay for reviews or incentivize positive reviews. Any material connections between reviewers and facilities, if known, will be disclosed.


6. State-Specific Disclosures

CuraCare currently provides facility data for six states: California, Texas, Florida, New York, Illinois, and Pennsylvania. The following state-specific disclosures apply to users in those states.

California

CCPA/CPRA Disclosure: Under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), California residents have the right to know what personal information we collect, the right to delete personal information, the right to opt out of the sale or sharing of personal information, and the right to non-discrimination for exercising privacy rights. CuraCare does not sell personal information. For details, see our Privacy Policy.

CalOPPA Compliance: In accordance with the California Online Privacy Protection Act (CalOPPA), our Privacy Policy is conspicuously linked from our homepage and describes how we respond to Do Not Track signals, what third-party tracking we allow, and how users may review and request changes to their personal information.

Texas

DTPA Disclosure: In compliance with the Texas Deceptive Trade Practices-Consumer Protection Act (DTPA), CuraCare represents that the information on our platform is sourced from public data and presented in good faith. We do not make false, misleading, or deceptive claims about any facility. CuraCare is an informational directory and does not guarantee the accuracy of third-party data.

New York

GBL 899-aa (Data Breach Notification): In compliance with New York General Business Law Section 899-aa, CuraCare will notify affected New York residents in the event of a data breach involving private information as defined under the statute. Notification will be made in the most expedient time possible and without unreasonable delay, consistent with any measures necessary to determine the scope of the breach and restore the integrity of our systems.

Illinois

BIPA Disclosure: CuraCare does not collect, capture, store, or use any biometric identifiers or biometric information as defined under the Illinois Biometric Information Privacy Act (740 ILCS 14). We do not use facial recognition, fingerprint scanning, voiceprint analysis, or any other biometric technology.

Florida

FIPA Disclosure: In compliance with the Florida Information Protection Act (FIPA, Section 501.171, Florida Statutes), CuraCare will notify affected Florida residents within 30 days of discovering a data breach involving personal information. We implement reasonable measures to protect and secure personal data in electronic form.

Pennsylvania

Breach Notification: In compliance with Pennsylvania's Breach of Personal Information Notification Act (73 P.S. Section 2303), CuraCare will provide notification to affected Pennsylvania residents without unreasonable delay in the event of a breach of security involving personal information.


7. Accessibility Statement

CuraCare is committed to ensuring that our platform is accessible to all users, including people with disabilities. We design and develop our platform to conform with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards.

Our accessibility efforts include semantic HTML structure, keyboard navigation support, screen reader compatibility, sufficient color contrast ratios, and large touch targets for mobile users.
