1. Acceptable Use

You agree to use the Service lawfully and respectfully. You may not:

• Scrape or harvest data: Use automated tools, bots, scrapers, or crawlers to extract data from CuraCare without our written permission.
• Submit false listings: Create or modify facility listings with inaccurate, misleading, or fraudulent information.
• Post fake reviews: Submit reviews for facilities you have not visited or that misrepresent your experience.
• Abuse rate limits: Circumvent or attempt to bypass rate limiting, authentication, or security measures.
• Harass or impersonate: Use the Service to harass, threaten, or impersonate any person or entity.
• Distribute malware: Upload or transmit viruses, malicious code, or any material that could harm the Service or its users.
• Reverse engineer: Decompile, disassemble, or reverse engineer any part of the Service.

We reserve the right to suspend or terminate accounts that violate these terms.

2. Facility Data Accuracy Disclaimer

CuraCare aggregates facility information from public sources including CMS (Centers for Medicare & Medicaid Services) data, state licensing databases, and facility-submitted profiles. While we strive for accuracy:

• Facility details (pricing, availability, services, ratings) may be outdated or incomplete.
• We do not independently verify every detail submitted by facilities.
• Pricing shown is based on reported ranges and may not reflect your specific care needs or current rates.
• You should always verify information directly with the facility before making care decisions.

CuraCare is an informational directory, not a medical or care provider. We do not endorse, recommend, or guarantee the quality of any facility listed on our platform.

3. AI-Generated Content Disclaimer

CuraCare uses AI technology (powered by Anthropic's Claude) for several features including:

• Amica: Our conversational care guide that helps families understand senior living options.
• Facility summaries: AI-generated descriptions of facilities based on available data.
• Match explanations: AI-powered analysis of how well a facility matches your stated preferences.
• Tour question generation: Personalized questions to ask during facility tours.
• Cost estimates: AI-enhanced estimates based on regional averages and your inputs.

AI-generated content is informational only and should not be treated as medical advice, legal advice, or a substitute for professional guidance. AI responses may contain inaccuracies. Always verify important information independently and consult qualified professionals for medical or legal decisions.

4. User Accounts

Some features require creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must provide accurate information and promptly update it if it changes. You may delete your account at any time by contacting privacy@curacare.us.

5. Facility Provider Terms

If you are a senior living facility listing on CuraCare:

• You must have the authority to represent the facility.
• Information you submit must be accurate and up to date.
• You are responsible for responding to tour requests in a timely manner.
• Free listings remain available indefinitely. Premium and Featured listings are subject to subscription terms below.

6. Payment Terms & Refund Policy

CuraCare offers paid subscription plans for facility providers (Premium and Featured tiers). Payment terms:

• All payments are processed securely through Stripe. CuraCare does not store your credit card information.
• Subscriptions are billed monthly or annually, depending on the plan selected. Prices are listed on our pricing page.
• Subscriptions automatically renew at the end of each billing period unless cancelled.
• You may cancel your subscription at any time from your dashboard. Your listing remains active through the end of the current billing period.
• Refund policy: We offer a full refund within 14 days of your initial subscription purchase if you are not satisfied. After 14 days, no refunds are provided for partial billing periods. Contact hello@curacare.us to request a refund.
• If a payment fails, your listing remains active for a 7-day grace period while we retry. After that, your listing is downgraded to the free tier.

7. Intellectual Property

The CuraCare name, logo, website design, and original content are owned by CuraCare, Inc. and protected by copyright and trademark law. Facility data sourced from public databases (CMS, state licensing) is in the public domain. User-submitted content (reviews, photos, descriptions) remains owned by the submitter, but you grant CuraCare a non-exclusive, royalty-free license to display it on the Service.

8. Limitation of Liability

To the fullest extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
• CuraCare is not liable for the quality, safety, or suitability of any facility listed on the platform.
• CuraCare is not liable for any decisions made based on information provided by the Service, including AI-generated content.
• In no event shall CuraCare be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim arising from the Service shall not exceed the amount you paid to CuraCare in the 12 months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless CuraCare, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive (liability limitations, indemnification, governing law) will continue in effect.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
